Terms of Service

1.Agreement

These terms are an agreement between you and SkiT ("SkiT", "we", "us"), a social-commerce platform operated in Kenya. By creating a SkiT account or using skitapp.co.ke, you accept these terms and our Privacy Policy. If you use SkiT on behalf of a business, you confirm you are authorised to bind that business.

2.The service

SkiT provides sellers with smart links, storefronts and sales analytics that route interested buyers from social platforms (such as TikTok, Instagram and Threads) to the seller's WhatsApp. SkiT is a tool for sellers: we are not a party to any sale between you and your buyers, we do not process payments between you and buyers, and we do not guarantee sales, taps or reach.

3.Your account

You must be at least 18 years old to use SkiT. You are responsible for keeping your password confidential and for all activity on your account. Give us accurate information (including a WhatsApp number you control) and keep it up to date. We may suspend accounts that appear compromised while we investigate.

4.Acceptable use

You agree not to use SkiT to:

Sell or promote anything illegal in Kenya or in your buyers' country, including counterfeit goods, stolen property, weapons or restricted substances;

Mislead buyers — for example with false prices, fake stock, or products you cannot deliver;

Send spam or unsolicited bulk messages, or otherwise violate WhatsApp's or any connected platform's terms;

Record buyer information you have no right to hold, or use buyer data for anything other than serving those buyers;

Interfere with the service, probe its security, or access other sellers' data.

We may remove content or suspend or terminate accounts that break these rules.

5.Your content

You keep ownership of the product photos, captions, prices and other content you add to SkiT. You grant us a licence to host, display and transmit that content as needed to run the service — for example showing your storefront to buyers who tap your link, or posting content to a platform when you explicitly choose to post it. You are responsible for having the rights to everything you upload.

6.Connected platforms

If you connect a third-party account (such as TikTok via TikTok Login Kit and the TikTok Content Posting API), your use of that platform remains governed by its own terms. Content is sent to a connected platform only when you explicitly choose to post it. You can disconnect a platform at any time from your SkiT profile or from the platform's own settings.

7.Fees

Where SkiT charges fees, the current pricing will be shown to you before you subscribe. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice to active sellers.

8.Availability and changes

We work to keep SkiT available and reliable, but the service is provided "as is" and "as available". We may add, change or withdraw features, and we may perform maintenance that temporarily interrupts the service. We are not responsible for the availability of third-party platforms such as WhatsApp, TikTok, Instagram or Threads.

9.Limitation of liability

To the maximum extent permitted by law, SkiT is not liable for indirect or consequential losses, lost profits, or lost sales arising from your use of the service. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose, or KES 5,000 if you paid no fees. Nothing in these terms limits liability that cannot be limited under Kenyan law.

10.Termination

You can close your account at any time by contacting us. We may suspend or terminate your account if you break these terms, if the law requires it, or with reasonable notice if we discontinue the service. On termination, sections that by their nature should survive (including sections 5, 9 and 11) continue to apply.

11.Governing law

These terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of the Kenyan courts. We will always try to resolve any issue with you directly first — just email us.

12.Changes to these terms

If we make material changes we will update the effective date above and notify active sellers by email or in the app. Continued use of SkiT after a change means you accept the updated terms.
